Terms of Service

These terms cover your use of PAGAlert. We have tried to write them in plain English rather than borrowed boilerplate.

What PAGAlert does

PAGAlert watches California's public PAGA filing database and tells you when a new filing or status change matches an employer, law firm, attorney or case number you have asked us to track. It also gives you somewhere to keep notes, tags and a status against the cases you find.

The underlying filings are public records published by the California Department of Industrial Relations. We do not create them, we do not verify them, and we cannot correct them. If a filing is wrong, the correction has to come from DIR.

Who PAGAlert is for

PAGAlert is offered only to businesses, firms and professionals based in the United States. It is not directed at anyone in the European Union or the United Kingdom, and an account may not be opened for a business based there.

This is not legal advice, and matching is imperfect

PAGAlert is not a law firm and does not provide legal advice. Nothing here is a substitute for a lawyer's judgment. We monitor a public database and tell you when something in it matches a name you asked us to watch — that is all.

Matching a name to an entity is genuinely hard. Companies file under trading names, subsidiaries, misspellings and abbreviations, and two unrelated businesses can share a name. We propose likely matches and let you confirm or reject them; we never add one on your behalf. You should expect both misses and false positives, and you should not rely on PAGAlert as your only source of truth for anything that matters. Check the filing itself before acting.

We do not promise that every filing will be found, that it will be found within any particular time, or that the service will be available without interruption.

Alerts are informational. They are not a substitute for your own monitoring of DIR, of court dockets, or of any deadline that matters to your practice, and we do not guarantee that they are complete or timely.

Your account

You are responsible for what happens under your account, including keeping your password and any API keys you create to yourself. Tell us promptly if you think either has been exposed.

One account is for one person or one firm. Sharing credentials outside your organisation, or reselling access, is not permitted.

Plan limits

Each plan has a hard cap on how many entities you can monitor. The cap is enforced, not billed: we will refuse the request rather than charge you for going over. There is no overage billing and no grace period. If you need more capacity, change plan.

Alert speed, available channels and API access also vary by plan. What each plan includes is shown on the pricing page, and the figures there are the ones the system enforces.

Acceptable use

You may use PAGAlert and its API for your own business. You may not:

  • resell, redistribute or republish our aggregated data as a competing product
  • use automated means to extract our aggregates or directory beyond the documented API and its rate limits
  • attempt to reach data belonging to another customer, or to circumvent a plan limit
  • use the service to harass a person, or to build a profile of a named individual unrelated to a filing
  • put load on the service that degrades it for others

The partner API

API keys are issued to your account and inherit its plan limits, including a per-key request budget. Keys are shown once when created and cannot be retrieved afterwards — if you lose one, revoke it and issue another.

We may change the API, but we will not remove or change the meaning of an existing documented field without giving at least 30 days' notice by email to the account's address on file.

Payment and cancellation

Paid plans are billed monthly in advance through Stripe. You can change plan or cancel at any time from the billing page; cancellation takes effect at the end of the period you have already paid for, and we do not pro-rate refunds for a partial month. Changing plan mid-month is prorated as a charge or credit on your next invoice.

If a payment fails we will retry it and email you. Persistent failure moves the account to the free tier rather than deleting anything.

Ending the agreement

You can stop using PAGAlert and delete your account at any time. We may suspend or close an account that breaches the acceptable-use section above, or where we are legally required to.

If we close your account other than for a breach, we will give you reasonable notice and a way to export your notes and tags first.

Liability

PAGAlert is provided as it is. To the extent the law allows, we are not liable for indirect or consequential loss, for lost profit or business, or for any decision taken in reliance on an alert we did or did not send.

Where liability cannot be excluded, it is limited to the amount you paid us in the twelve months before the claim.

Nothing here excludes liability for fraud, or for anything else the law does not permit us to exclude.

Governing law and disputes

These terms are governed by the laws of the State of California. Any dispute about them or about the service will be decided by the state or federal courts located in California, and both of us agree to those courts' jurisdiction.

Disputes go to court, not to arbitration.

Changes

We will email account holders before a material change to these terms takes effect. Continuing to use the service afterwards means you accept the change.
